Temporary Event Notices (TEN's) to allow Permitted Temporary Activities

Not every event where regulated entertainment (e.g films, plays, indoor sports, boxing or wrestling, live or recorded music and dancing) or the sale or supply of alcohol is to take place in a premises will require a premises licence to be in force. A good example may be a function held in a school by a Parent/ Teacher Association. This type of event can be quite lawfully held by serving a Temporary Event Notice (TEN) on the Licensing Authority and the Police.
TEN's have replaced the temporary permissions such as occasional licences that were granted previously by the Magistrates Court. TEN's can also include extensions for pubs and clubs.
A non-personal licence holder may have 5 TEN's in a calendar year (January to December) and a personal licence holder may have no more than 50, but not more than 12 events on his/her own premises. The total aggregate number of days in a calendar year cannot exceed 15 days for the same premises.
Each event cannot exceed 96 hours with the total number of persons attending an event at any one time cannot be more than 499.
The fee for a TEN is £21.00. Two copies of the completed form must be sent to the Licensing Authority and one to Merseyside Police Licensing Unit at least 10 working days before the proposed temporary event is to take place.
Only the Police can object to a TEN on crime and disorder grounds.
It is important to note that unless the forms are correctly completed and are accompanied by the fee, they may be rejected and returned.
