Motor salvage operator guidance notes

VEHICLE (CRIMES) ACT 2001 MOTOR SALVAGE OPERATORS REGULATIONS 2002

Vehicle crime is one the largest singly recorded crime in the United Kingdom. This legislation was introduced in order to regulate the motor salvage and dismantling industry and thus reduce the possibilities of criminal element disposing of stolen cars through the industry.

REGISTRATION

All motor salvage operators must register with the Local Authority in which their premise is in. Registration will last for 3 years from date of issue and all re-applications have to be made at least 2 months prior to expiry of their current licence. The fee for registration in £70.00 and cheques should be made payable to Liverpool City Council. All applicants will be subject to a Police Check. All unspent convictions must be revealed when making an application. Details of any undischarged bankruptcy must also be revealed when making application.

CHANGES IN APPLICATION

The registered person must give any information of changes from their original application in writing within 28 days. Any motor salvage operator who ceases to operate as such must inform the Local Authority within 28 days of the date on which they cease to trade. Failure to comply with the regulations will be an offence and liable on summary conviction to a fine not exceeding level 3 on the standard scale (i. e not exceeding £1000)

WHO SHOULD BE REGISTERED

A person has to be registered if he carries out a business as a Motor Salvage Operator that consists of:

  1. Wholly or partly in the recovery for re-use or sale of salvageable parts from motor vehicles and the subsequent sale or other disposal for scrap of the reminder of the vehicles concerned
  2. Wholly or mainly in the purchase of written off vehicles and their subsequent repair and resale
  3. Wholly or mainly in the sale or purchase of motor vehicles which are to be the subject (whether immediately or on a subsequent re-sale) of any of the activities mentioned in points 1 and 2
  4. Wholly or mainly in activities falling within paragraphs 2 and 3 Details of all applications will be available for public access
