What the law says


What the law says about Religion, Faith and Belief.

The Employment Equality (Religion and Belief) Directive 2003 says that:

. Employees and job applicants are protected from any act of discrimination or harassment based on their religion, faith or belief. 

. The same terms apply to religion, faith and belief as in the Racial Equality Directive on definitions of discrimination; rights of legal redress and the sharing of the burden of proof. 

. There are a few times when equal treatment cannot happen, for example, in order to keep the ethos of religious organisations.  

Good Practice.

The Law does not say that employers have to:

. Monitor the religious make up of their staff.  
. Grant staff time off for religious festivals. 
. Provide prayer rooms.  

But employers should consider all of these to show a commitment to promoting diversity, equality and inclusion.
