Data Protection and Freedom of information Act

DATA PROTECTION

The Data Protection Act 1998 was created to ensure that information about individuals is processed in accordance with the rights provided in the Data Protection Act 1998 together with providing them with safeguards to prohibit any non-compliant or unauthorised processing.

The Act itself provides individuals with the specific right of:-

  • They have the right to know what information is being held about them,
  • They have the right to know what their information is being used for and why,
  • They have the right to know where the information came from and who has accessed it, 
  • They have the right to request access to their information,
  • They have the right to take action to block, rectify, erase or destroy inaccurate data.

FREEDOM OF INFORMATION

The Freedom of Information Act 2000 provides a general right to anyone to access information held by a Public Body, subject to the consideration of 23 exemptions. These exemptions are either Absolute or Conditional the latter requiring the consideration of a Public Interest Test. There is also a Publication Scheme which provides information on what is already available to the Public and what can be made available.

The Environmental Information Regulations were created to support and work with the Freedom of Information Act 2000 but in respect of Environmental Information.
